YourShoot.com Terms & Conditions (for the seller / photographer):

YourShoot.com is a division of Imagecare Technical Services Ltd. Registered at 172 Blackberry Lane, Four Oaks, Sutton Coldfield, West Midlands, B74 4JR. Reg. in England no. 3630078, VAT no. GB 715 24 66 45.

Images:

• All images on YourShoot.com remain the property of the photographer. Any unauthorised reproduction of part or all of the contents of any image, in any form is prohibited. Images will remain online for a period of time at the photographer’s discretion and Imagecare Technical Services Ltd take no responsibility for the removal of images from the website.
• Imagecare Technical Services Ltd reserves the right to remove images which we believe to be unacceptable and / or cancel an account if it is being used inappropriately, and to contact the authorities if deemed appropriate.
• NO violent, unlawful or sexually explicit material or material which could cause offence or incite unlawful behaviour will be uploaded or sold through YourShoot.com. The photographer is responsible for the images that are displayed on their account and the images available under each login code which they assign.
• The photographer reserves the right to select the images they wish to be uploaded onto their account space. It is the photographer’s responsibility to upload and remove images and to determine the length of time that they are online for.

Orders:

• Imagecare Technical Services Ltd reserves the right to accept or refuse any customer order, without prior notification at our discretion. It is the customer's responsibility to inform YourShoot.com if any contact information changes which may affect the delivery of an order.
• Imagecare Technical Services Ltd can not be held responsible for the fulfilment of orders or delivery of such orders. Any delayed, incomplete or incorrect orders are the sole responsibility of the photographer.
• It is the customer's responsibility to select and purchase the correct photos on the website; Imagecare Technical Services Ltd will not be responsible for refunding prints ordered in error.
• Imagecare Technical Services Ltd reserves the right to accept or refuse any customer order at our discretion.
• If the photographer identifies an incorrect order through YourShoot.com, or is contacted about one, they should contact YourShoot.com immediately. Imagecare Technical Services Ltd is not responsible for the failed delivery of information or orders (via email or post) if contact details have been incorrectly entered by the photographer or customer.
• It is the photographer’s responsibility to appoint their own photo lab for processing and printing their orders unless a request is made to Imagecare Technical Services Ltd.
• It is the photographer’s responsibility to ensure that the photo lab is informed about and accepts the YourShoot.com ordering process.
• It is the photographer’s responsibility to have in place all pricing structures and agreements between themselves and the photo lab for work produced through YourShoot.com.
• It is the photographer’s responsibility to ensure that their customer’s orders are processed, printed and delivered to the standard and cost expected by their customer.

Payments:

• Once the order is completed, payment will be deducted automatically from the customer's credit or debit card.
• Imagecare Technical Services Ltd will credit (by Direct Debit) the photographer with the amount earned by sales through their YourShoot.com account, minus the commission charge, when directed to by the photographer / account holder.
• If the YS Xtra account has been selected, the photographer will pay a monthly fee of £25.00 (GBP; excluding VAT) to Imagecare Technical Services Ltd. This fee will be automatically debited from the photographer’s account by Direct Debit, as agreed, per month. No monthly fee will be charged for the YS Standard account.
• The commission charges and, if applicable, the monthly fee, will not be changed by Imagecare Technical Services Ltd unless otherwise agreed with the photographer / YourShoot.com account holder.
• In the event that a photographer or customer supplies a non-existent credit / debit card number, or the number of a credit / debit card that belongs to someone else, Imagecare Technical Services Ltd reserves the right to terminate the appropriate customer order or photographer’s account without prior notice and to contact the authorities as necessary.

Quality of service:

• Imagecare Technical Services Ltd accepts no liability for quality of both the images displayed online and also the quality of the end product supplied.
• Imagecare Technical Services Ltd accepts no responsibility for any delays incurred by the photographer, their lab or customer, or any third party including postal disputes and industrial action.
• If the photographer is experiencing difficulties with the YourShoot.com service or are informed by a customer about any difficulties, they should inform YourShoot.com immediately.
• The photographer should set up their facilities, products and pricing structures, and test the selling process before allowing their customers to use the YourShoot.com service.
• It is the photographer’s responsibility to ensure prints / products received by their customers are of the highest possible quality and received on time.

Cancellations and refunds:

• Imagecare Technical Services Ltd reserves the right to cancel a photographer’s YourShoot.com account if they are suspected of using the service for reasons other than to sell their photos through YourShoot.com.
• Imagecare Technical Services Ltd reserves the right to cancel a photographer’s YourShoot.com account after a period of 3 months if no orders have been taken through their account.
•Imagecare Technical Services Ltd is not responsible for refunding orders that have been ordered by mistake by a customer or because of the incorrect management of the photographer’s account. It is the photographer’s responsibility to offer their correct products, prices and discounts etc. and the customer’s responsibility to select and purchase the correct items.
• Where appropriate, Imagecare Technical Services Ltd will endeavour to rectify a situation where a refund is asked for. However it is the photographer’s responsibility to decide whether a refund is valid for individual customer cases. Imagecare Technical Services Ltd will only refund a customer on a photographer’s behalf if authorised to do so and when all costs have been settled.
• It is the photographer’s responsibility to rectify any problems between themselves, their customers and their labs regarding order cancellations or changes.
• If an incorrect invoice or purchase order is sent out to a customer, photographer or lab by YourShoot.com resulting in a customer receiving an incorrect product or the photographer loosing money on the specified order, Imagecare Technical Services Ltd will refund the customer / photographer accordingly.

Liability:

• YourShoot.com and all software on it is the property of Imagecare Technical Services Ltd.
• It is prohibited to copy, modify or transfer any part of YourShoot.com or its software without the permission of Imagecare Technical Services Ltd.
• Imagecare Technical Services Ltd will not be held responsible for any loss of income due to delayed, incomplete or incorrect orders.
• In no event will Imagecare Technical Services Ltd be liable to the photographer, their lab or customer, or any third party for any damages, including any lost profits, lost savings or other incidental or consequential damages arising out of the use or inability to use this software or service.
• Imagecare Technical Services Ltd will endeavour to rectify any problems or errors that result from using YourShoot.com.
• If the photographer becomes aware of any unlawful use of their own or any other YourShoot.com account, they should contact YourShoot.com immediately.
• The photographer is responsible for the up-to-date management of their YourShoot.com Control Panel, including the product list they offer, their print / product prices, their discount offers, and that they ensure emails are correctly directed to themselves and to the lab. Any loss of earnings or incorrect customer orders because of the incorrect management of a photographer’s account is solely the responsibility of the photographer / YourShoot.com account holder. Imagecare Technical Services Ltd can not accept responsibility for any changes made by the photographer at any time.
• The photographer should ensure that their contact details listed under ‘General Setup’ in the control panel are correct and up-to-date. It is the photographer’s responsibility to inform YourShoot.com if any contact information changes which may affect payment or a customer’s order.
• The photographer and their customers should keep the username / login code and password secure at all times. They are responsible for any damage caused by unauthorised access resulting from failure to keep the username or password secure.

Confidentiality:

• The confidentiality of the customer's details is the responsibility of the photographer. Imagecare Technical Services Ltd will not take any responsibility for information passed on to other bodies / parties by the photographer or their clients.
• Any contact information supplied by the photographer and their customers to YourShoot.com will be kept securely and in the strictest confidence and will not be passed on to any other bodies / parties without prior agreement.

• Imagecare Technical Services Ltd is not responsible for the length of time a photographer wishes to keep their images online for.

• It is the photographer’s responsibility to ensure that their customer’s orders are processed, printed and delivered to the standard and cost expected by their customer.
• Imagecare Technical Services Ltd reserves the right to accept or refuse any customer order, without prior notification at our discretion. It is the customer's responsibility to inform YourShoot.com if any contact information changes which may affect the delivery of an order.
• Imagecare Technical Services Ltd can not be held responsible for the fulfilment of orders or delivery of such orders. Any delayed, incomplete or incorrect orders are the sole responsibility of the photographer.
• It is the customer's responsibility to select and purchase the correct photos on the website; Imagecare Technical Services Ltd will not be responsible for refunding prints ordered in error.
• Imagecare Technical Services Ltd is not responsible for the length of time taken by the photographer or their lab to process and print their customer’s photographs.
• Imagecare Technical Services Ltd is not responsible for the failed delivery of information or orders (via email or post) if contact details have been incorrectly entered by the photographer or customer.

Payments:

• Once the order is completed, payment will be deducted automatically from the customer's credit or debit card account.
• In the event that a customer supplies a non-existent credit / debit card number, or the number of a credit / debit card that belongs to someone else, Imagecare Technical Services Ltd reserves the right to terminate the appropriate customer order without prior notice and to contact the authorities as necessary.
Quality of service:
• Imagecare Technical Services Ltd accepts no liability for the quality of both the images displayed online and the end product supplied. Imagecare Technical Services Ltd can not guarantee that specific photographs will appear on the website.
• Imagecare Technical Services Ltd accepts no responsibility for any delays incurred by the photographer, customer or third party services including postal disputes and industrial action.
• If the customer is experiencing difficulties with the YourShoot.com service, they should inform YourShoot.com immediately.
• Imagecare Technical Services Ltd can not accept responsibility for the quality of the photographs ordered. If YourShoot.com has been chosen by the photographer to process and print an order, Imagecare Technical Services Ltd will endeavour to ensure the greatest quality prints / products possible from the image(s) supplied by the photographer.
• It is the photographer’s responsibility to ensure prints / products received by their customers are of the highest possible quality and received on time.

Cancellations and refunds:

• Imagecare Technical Services Ltd is not responsible for refunding orders that have been ordered by mistake by a customer or because of the incorrect management of the photographer’s account. It is the photographer’s responsibility to offer their correct products, prices and discounts etc. and the customer’s responsibility to select and purchase the correct items.
• Where appropriate, Imagecare Technical Services Ltd will endeavour to rectify a situation where a refund is asked for. However it is the photographer’s responsibility to decide whether a refund is valid for individual customer cases. Imagecare Technical Services Ltd will only refund a customer on a photographer’s behalf if authorised to do so and when all costs have been settled.
• The customer should contact YourShoot.com and their photographer directly if they wish to cancel an order. It is the photographer’s responsibility to rectify any problems between themselves and their customers regarding order cancellations or changes.
• If incorrect information is sent out to a customer, photographer or lab by YourShoot.com resulting in a customer receiving an incorrect product or the photographer loosing money on the specified order, Imagecare Technical Services Ltd will refund the customer / photographer accordingly.

• Imagecare Technical Services Ltd will endeavour to rectify any problems or errors that result from using YourShoot.com.
• The customer should keep their login code and password secure at all times. They are responsible for any damage caused by unauthorised access resulting from failure to keep these secure.

• The confidentiality of the customer's details is the responsibility of the photographer. Imagecare Technical Services Ltd will not take any responsibility for information passed on to other bodies / parties by the photographer or their clients.
